Sheriff Doesn’t Like Rights On Independence Day

Last year, Murfreesboro unmarked police stopped me illegally on Highland Ave. within a mile of my house and questioned me as to why I was driving in my own neighborhood. I called the station and went in person to complain, but was basically blown off by government employees who didn’t seem interested in taking a formal complaint. The blog I wrote about the encounter can be found here: http://www.copblock.org/17140/veterans-should-know-better/

Deputy AJ Ross

On the 4th of July of 2013 (yesterday, as of this writing), a similar incident happened to another law-abiding motorist named Chris Kalbaugh at a Rutherford County Sheriff’s DUI checkpoint in the same jurisdiction. Deputy AJ Ross is clearly upset that Mr. Kalbaugh is exercising his Constitutional Rights and makes the snide remark, “But he’s perfectly innocent and he knows his rights. He knows what the Constitution says.” Deputy Ross first seems to get upset when Mr. Kalbaugh expresses that he can hear the deputy just fine with the window partially rolled down and is apparently uncomfortable answering questions without probable suspicion. In the video, Chris is seen being compliant and cordial with police, but that doesn’t stop the officers from ordering him out of the vehicle and instigating a “false hit” by a K-9 so as to have an excuse to illegally search the vehicle. Apparently, no contraband is found. Kalbaugh alleges that the K-9 was physically on the hood of his car and left scratches on the car. Video of the encounter has gone viral on the internet. Here’s the video taken by the motorist:

Ross lies

Details of the July 4th, 2013 incident involving Deputy Ross and motorist Chris Kalbaugh are still sketchy and no official statement has been released or press conference scheduled as to this citizen journalist’s knowledge. But, reports thusfar have stated that the Rutherford County Sheriff’s Department is disappointed that Mr. Kalbaugh chose to upload video of the incident on YouTube as opposed to lodging a formal written complaint with the department and there’s no reports of the Sheriff’s office offering to make restitution for the scratches left by the K-9 on the vehicle. After such an abuse of police power occurred against Chris, maybe one can’t blame him for not wanting to appeal to the very people who were harassing and intimidating him to investigate themselves.

I took this video today at the Rutherford County Sheriff’s Department, but my recording equipment died before I could get a formal interview. I was told someone named “Lisa” was “handling it” anyway, and there would be no further information at the window:

AJ Ross Some of us took an oath to the Constitution and took seriously our responsibility to defend the inalienable Rights spelled out in the Bill of Rights for each individual American. For those of us who have seen American blood shed in combat to preserve a place where people should never be treated as slaves, the actions of law enforcement officers like AJ Ross cuts to the bone and wrenches our heart. It’s a damn shame to put your life on the line for freedom, only to see that freedom so flippantly disregarded by those with badges and uniforms who swore to serve us and protect those rights per their Constitutional oath. The question now is; will there be any accountability? Or, will we see the same old story play out in which peaceful law-abiding citizens get run over by corrupt government goons who never face the same consequences they would force on others.

  1. Dirty dirty ass cops. I live in Murfreesboro and know of one MPD officer who lied right on the witness stand. This does not surprise me one bit. Props to the guy asserting his rights.

  2. “The Michigan Supreme Court had found sobriety roadblocks to be a violation of the Fourth Amendment. However, by a 6-3 decision in Michigan Dept. of State Police v. Sitz (1990), the United States Supreme Court found properly conducted sobriety checkpoints to be constitutional. While acknowledging that such checkpoints infringed on a constitutional right, Chief Justice Rehnquist argued the state interest in reducing drunk driving outweighed this minor infringement.”

  5. “Most disturbing, is that Rep. Womick doesn’t recognize that the Constitution and the government does not grant any rights. It simply outlines the government’s role to protect them. Our rights were given to us by God and may not be justly removed by any stroke of the pen. Unfortunately our officials seem to think they are a higher authority then the Almighty.”

  6. Further information on Tennessee checkpoints and the controversy of unconstitutional mandatory blood-surrender for the Dept. of Homeland Security:

EPISODE 35: “TN ‘No Refusal’ Checkpoints Scheduled For Independence Day”
…Starting at 6pm on Wednesday July 3rd the Tennessee Department of Homeland security will be setting up “No Refusal” checkpoints where anyone suspected of being under the influence must either consent to a breath/blood test or they will be strapped to a gurney and the blood will be forcibly drawn. This is a clear violation of both the 4th and 5th amendments. Tune in to see how the 5th amendment not only forbids this practice, it actually calls for compensation when private property is seized for the public welfare.
Georgia and Tennessee both passed laws allowing police officers to call a judge to get a rubber stamped search warrant…
